CFR Part 2 vs. HIPAA: What Substance Use Providers Need To Know

Substance Use Providers need to abide by two different sets of federal regulations, 42 CFR Part 2 and HIPAA.  The regulations however, vary and at times disagree.  This session will provide an overview of both regulations and how they differ.  Participants will discuss these differences both in theory and practice so that new and seasoned substance use providers have the tools they need to best communicate with other entities, individuals and agencies.  Techniques for applying Part 2 rules when working with non-Part 2 providers and how best to facilitate these working relationships will be a component of discussions and scenarios throughout the training. This session will provide a general overview of the differences between these two laws and provide new and seasoned SUD providers with the tools they need to effectively navigate these laws in their practice. As a result of this training participants will: 

  • Learn the fundamental differences and what they look like in practice;

  • Learn techniques to utilize Part 2 rules when working with non- Part 2 providers and how to better facilitate these working relationships; and

  • Discuss real-life scenarios and identify how to navigate different Part 2 situations.
